Against the background of the current European competitive media landscape, the media are more and more compelled to legitimize their activities in their own national context as well as at a European level. Meanwhile, the nature of the media diversity in The Netherlands has changed tremendously; from a society divided along political and religious lines, it has evolved towards a multi-ethnic society. Hence, both the conceptualizing and operationalizing of media diversity from an academic as well as a media practical perspective (...) prove to be hot topics. An expert meeting was held at the Department of Communication at Radboud University Nijmegen in December 2004 in which the contours of media diversity in general and in The Netherlands in particular were explored. Institutional performance as well as program-related aspects linked to the notion of media diversity were discussed. Media diversity was explored from the angle of media economics as well as from the perspective of the program/format level. In addition, the audience reception perspective as well as methodologically problematic aspects one encounters when measuring media diversity were assessed. What follows here is a selection of several most pertinent views on this complex topic. We welcome each critical insight from other geographical contexts which might stimulate the debate on measures of open and reflective diversity in the media. (shrink)

In this paper I argue that the case of Einstein׳s special relativity vs. Hendrik Lorentz׳s ether theory can be decided in terms of empirical evidence, in spite of the predictive equivalence between the theories. In the historical and philosophical literature this case has been typically addressed focusing on non-empirical features. I claim that non-empirical features are not enough to provide a fully objective and uniquely determined choice in instances of empirical equivalence. However, I argue that if we consider arguments (...) proposed by Richard Boyd, and by Larry Laudan and Jarret Leplin, a choice based on non-entailed empirical evidence favoring Einstein׳s theory can be made. Adaptive Planning is an approach to planning in the commonsense domain. An adaptive planner takes advantage of the habitual nature of many of the planning situations for which it plans by bosing its activities on a memory of pre‐stored plans. A critical issue, and the subject of this paper, is the question of flexibility: How does an adaptive planner refit an old plan in order to meet the demands of some new planning situation? An adaptive planner refits prestored plans by (...) constructing an interpretation of the situation in which it is engaged. Key elements in the theory of adaptive planning are its treatment of specific plans and a notion of situation matching. Bioethics and feminist scholarship has explored various justice implications of nonmedical sex selection and family balancing. However, prospective users’ viewpoints have been absent from the debate over the socially acceptable bounds of nonmedical sex selection. This qualitative study provides a set of empirically grounded perspectives on the moral values that underpin prospective users’ conceptualizations of justice in the context of a family balancing program in the United States. The results indicate that couples pursuing family balancing understand justice primarily in individualist (...) and familial terms rather than in terms of social justice for women and girls or for children resulting from sex selection. Study participants indicated that an individual’s desire for gender balance in their family is ethically complex and may not be inherently sexist, immoral, or socially consequential, particularly given the social context in which they live. Our findings suggest that the social conditions that contribute to prospective users’ desires for gender balance in their families may direct them away from recognizing or engaging broader social justice concerns relating to sexism and stratified reproduction. Disputes regarding the ethics of work by children have intensified in recent years, with little resolution. The impasses stem from failure to recognize the diverse forms of child work and a lack of empirical research regarding its causes and consequences. We report on data gathered in Brazil’s export-oriented shoe industry, which is notorious for the employment of children. Central findings are: 1) the causes of child work have less to do with backwardness and more to do with how shoe workers (...) are integrated into the global order; 2) local employers and children regard this work as benign, but the U.S. government sees it as hazardous to children and unfair to U.S. producers; 3) efforts to remove children from the shoe industry have been frustrated by local resistance and raise ethical questions; and 4) in certain circumstances, efforts to eliminate hazards from the workplace are morally superior to campaigns to remove childworkers from employment. The overall objectives of this article are to help the reader see and understand through Aristotelian lenses: (1) positive and negative aspects of the Leveraged Buyout (LBO) business model; and, (2) how LBO practices can be reformed so as to retain positives and reduce negatives. Aristotelian lenses considered are: wealth acquisition through wealth expansion, wealth creation, and wealth transfers; distributive and corrective justice; and, a dialectic analytic process of retaining positives, reducing negatives, and reforming. Key net positive wealth expansion aspects (...) of the model are discussed with respect to: profitability for the owners, managers, and investors of LBO firms; potential productivity improvements on the cost and revenue sides; and, potentially greater credit availability. Negative wealth transfer and destruction aspects with respect to: a relatively high rate of bankruptcies in some countries and in economic downturns; LBO firm gains without responsibility for losses; wealth transfers from employees, creditors, ordinary vs “carried interest” taxpayers; and, damaged wealth expansion and creation capabilities of acquired organizations are discussed. How may emergent biotechnologies impact upon our relations with other animals? To what extent are any changes indicative of new relations between society and nature? This paper critically explores which sociological tools can contribute to an understanding of the technologisation of animal bodies. By drawing upon interview data with animal scientists I argue that such technologies are being partly shaped by broader changes in agriculture. The complexity of genomics trajectories in animal science is partly fashioned through the deligitimisation of the (...) productivist paradigm but continue to sit in tension around particular conceptions of sustainability in farm animal production.In spite of this deligitimisation process genomics is now being framed in the context of a new productivism (termed the livestock revolution) bound up in projected global changes in animal consumption during the first half of the 21st century. This potentially jars against both social trends that seek to re-enchant animal life and sustainability discourses which include social and environmental contexts. Nevertheless the possibility of a new productivism is supported by various interconnected trends including the emergence of a discourse of the 'bioeconomy' and a liberal regulatory apparatus for farm animal breeding technologies. Ultimately an understanding of the possibility of emerging new bio-capitalisations on animal life should be set in a broader context of competing agricultural paradigms as well as ongoing tensions over 'naturalness' in human/animal relations. This article offers a theoretical and doctrinal solution to a vexing question in public law: how to determine the justifiability of Charter rights-limiting administrative decisions. The jurisprudence suggests three approaches, or modes of reasoning: minimal impairment analysis, ‘interest balancing’, and ‘values-advancing reasoning’. Like Cerberus, the guard dog of Hades, Canadian public law has become three-headed. While scholars and courts argue about which mode of reasoning is categorically best, the culture of justification compels us to ask instead which provides the most (...) compelling explanation for each rights-limiting decision. Just as cutting off one of Cerberus’s heads would diminish his effectiveness as a guard dog, rejecting either of the modes of reasoning would limit decision makers’ capacity to explain their decisions and undermine a culture of justification. The article makes a theoretical case for retaining all three modes of reasoning and sets out a doctrinal approach to determining when each is applicable. (shrink)

In this paper, we reconstruct the debate between Zhuangzi 莊子 and Hui Shi 惠施 that took place on the bridge over the Hao River 濠水 as a substantive debate concerning the epistemic other‐mind skepticism according to which no one mind knows the mental states of the other. We demonstrate how this reconstruction leads to substantive conclusions of the viability of Hui Shi’s position in particular and of the other‐mind skepticism in general. This demonstration is accomplished by means of the contemporary (...) philosophical development regarding, for example, whether asserting a proposition implies that the asserter knows the proposition, whether the closure principle of epistemic logic should be held, and whether knowing something is a mental state. The central question of this paper is if philosophical inquiry is possible on the Internet. I will therefore investigate both subjects, try to come to a conclusion and to some recommendations. To get a better idea of the relevance of this question, I will:• elaborate briefly on the history of the Internet, discuss its possibilities and technical aspects,• elaborate briefly on philosophical inquiry and its main characteristics,• try to find some common aspects in both,• discuss the history and the evolution (...) of the existing electronic discussion list (the [email protected]) and expand on the results of a questionnaire I sent to every member on the list.I will try to show that real philosophical inquiry is primarily a matter of communication, both verbal and non-verbal.
